UNIGE–IISD Lunch Series on Investment Disputes: Investment Arbitration and Criminal Conduct

Investment arbitration and criminal conduct is the topic for the fourth in a series of public luncheons exploring the complexities of investment disputes at the University of Geneva.

We will discuss Al Warraq v. Indonesia and other cases involving related issues. This unusual ICSID award involved alleged criminal conduct of the claimant during its operation of an investment in Indonesia. On the one hand, the arbitral tribunal found the proceedings at the Indonesian criminal court violated both international and domestic laws. On the other hand, the tribunal recognized that treaties between the state parties could directly impose international law obligations on a foreign investor.

What does this award mean more generally for situations where an investor brings an investment claim but has been involved in criminal activities or other wrongdoings? How will tribunals likely deal with similar issues in the future? How could states address such situations in future investment treaty practice? Join barrister Mahnaz Malik to discuss.

She routinely conducts arbitrations for sovereigns and corporations governed by ICSID, UNCITRAL, ICC, LCIA and other procedures. She is a member of the ICSID Panel of Arbitrators and sits on the editorial board of the ICSID Review.
